Pilar Rose Accused of Bank Fraud and Identity Theft

Pilar Rose, 58, of Fresno, California was charged with bank fraud, tax evasion, obstructing an IRS tax investigation, and aggravated identity theft today.

Rose, who oversaw her husband’s orthodontics business, allegedly perpetrated bank fraud by using fake income statements to secure a $1.4 million home refinance as well as a loan for a BMW, according to court records. By taking out the second loan using an acquaintance’s Ss Number, she committed felony identity fraud.

In 2014 and 2015, Rose avoided paying over $400,000 in taxes. During an IRS investigation, she then altered and created financial statements to make living expenses seem to be exempt company expenses.

The announcement was made by Acting US Attorney Phillip A. Talbert.

This case is the result of an IRS Criminal Investigation independent review. The case is being prosecuted by Assistant US Attorney Joseph Barton.

Rose faces a maximum sentence of five years in imprisonment and a penalty of up to $250,000. If convicted of tax evasion, she faces a maximum punishment of five years imprisonment and up to a $250,000 penalty. If she is found guilty of obstructing an IRS investigation, she faces up to three years imprisonment and a penalty of up to $250,000. She faces a potential sentence of 30 years imprisonment and a penalty of up to $1 million if convicted of bank fraud. If guilty of felony fraud and identity theft, she faces a sentence of two years imprisonment, plus a penalty of up to $250,000, in addition to any other sentence she might get. Any punishment, on the other hand, will be decided at the court’s discretion while considering applicable statutory factors. The accusations are just that: allegations; the suspect is deemed innocent unless and before she is proved guilty of the crime.
